Child Benefit and non
EEA parents
There is good news for migrant workers and students who have
had children born in Northern Ireland prior to 31 January 2005. The
Home Office has recently confirmed that a non-EEA national parent,
who is lawfully in the UK and has an Irish child (or other EEA
national children), is entitled to Child Benefit, despite being
subject to immigration control (i.e. having a ‘no recourse to public
funds’ stamp in her/his passport). The person would also be entitled
to claim Child Benefit for any other children as well. The Home
Office has confirmed that in these circumstances claiming and
receiving Child Benefit will not affect any application for further
or indefinite leave to remain in the UK. |

Conference Tribunals: a Time for Change
is the theme of a conference held today at Belfast's Hilton Hotel.
The Leggatt report, Tribunals for
Users: one system, one service was published in 2001. A series
of major reforms have now been introduced in Great Britain.
The conference asks what are the lessons for Northern Ireland and
what changes are needed here.
The conference was organised by
the Office of the President of Appeals Tribunals and sponsored by
the Office of the President of Appeal Tribunals Northern Ireland,
the Department for Constitutional Affairs and Law Centre (NI). |

area, has produced a useful information briefing on eligibility for
free health and social services treatment for non UK-nationals. The

The Department of Justice has stated
that the latest date for making a post-nuptial declaration of Irish
citizenship is 29th November 2005. After that date Irish citizenship
can only be obtained via an application for naturalisation.

myths
How many asylum seekers are there
in Northern Ireland? What is the difference between an asylum seeker
and a refugee? Why do people come here? Where do they come from?
To provide the answers to these and
many more questions, the Refugee Action Group has just produced the
2nd edition of Forced to Flee: frequently asked questions about
refugees and asylum seekers in Northern Ireland. The new
information guide on refugee issues aims to deliver the facts - not
the myths - about asylum in Northern Ireland, so fostering a more
welcoming climate here for refugees. Copies are available from
Amnesty International, Centre for Global Education and

Immigration
Important changes to
right to marry
According to a press release issued by the Home Office on 14
December 2004, after 1 February 2005 anyone under immigration
control will have to give notice of intention to marry at a
specially designated registrar office which s/he must attend with
her/his partner. S/he will also have to meet strict new eligibility
criteria before the notice to marry is accepted. According to the
press release, the criteria may include:
n
entry clearance granted expressly for the purpose of marriage in
the UK; or
n
written permission from the Secretary of State to marry in the
UK in the form of a certificate of approval from the Home
Office’s Immigration and Nationality Department; or
n
s/he falls within a class of persons specified by the Secretary
of State.
It is
questionable whether the Home Office could impose criteria that are
contrary to EU law with respect to free movement. These new measures
may therefore be open to legal challenge.
The
Assistant Registrar General wrote to the Law Centre’s immigration
unit on 8 December 2004, stating that specially designated registrar
offices had not yet been designated and that the Law Centre would be
informed of the new arrangement once they were available.
It has since been
clarified that a notice of intention to marry can be lodged with any
registrar office in Northern Ireland.

Human Rights Day events: 10 December 2004
To mark International Human Rights Day, Northern Ireland Human
Rights Commission held an event at Belfast City Hall, with
representatives from local human rights, community, public and
private sector organisations. Chief commissioner Brice Dickson,
Equality Commission’s Joan Harbinson, Children’s Commissioner Nigel
Williams, Belfast Islamic Centre’s Jamal Iweida and murdered
solicitor Pat Finucane’s widow Geraldine spoke on aspects of human
rights relevant to Northern Ireland today.
On the same day, Women into Politics held a conference at Grosvenor
House entitled Women’s Rights are Human Rights – women’s
participation and leadership in global processes. The conference,
which gathered together speakers from Zimbabwe to Afghanistan as
well as local representatives, was the culmination of a series of
workshops on women’s rights as human rights.
On the eve of human rights day, Amnesty International invited
prominent campaigner against torture Helen Bamber to give a lecture
on War, Women and Torture, at Queen’s University. |
