Introduction

Training Framework

The training framework has three levels, Foundation, Intermediate and Advanced. All courses are placed in the structure by being ascribed a level or a combination of levels using the descriptors set out on page 4. All Law Centre courses count towards CPD for solicitors. Application has been made to the Bar Library for Barristers CPD.

Venues

The courses are held at venues in Belfast and Derry. The vast majority of the Belfast courses are held in the Law Centre Central Office premises while courses offered in the Western Area are held in a number of different venues. Only venues with suitable facilities are used and all have disabled access.

Tutors

Most of the training courses are delivered by Law Centre staff, although outside speakers are brought in occasionally so that we may benefit from their particular experience. Tutoring is undertaken by Law Centre training officers and legal advisers. Legal advisers deliver training within their own specialist areas of work.

Applications

A standard procedure is used to offer courses to members. Information details and application forms are issued from the relevant office approximately eight weeks prior to the start of the course and can be downloaded from our website. Application forms (which may be photocopied) should be completed in full and returned to the relevant office by the closing date indicated. Please pay particular attention to the closing dates, especially for the Welfare Rights Adviser Programme, as late applications may not be considered at all because of the demand for places.

Fees

Details of course fees can be found in this programme as well as on the information flyers. Payment must be made either with the application form or one week before the course date. Please indicate on the application form if you require an invoice. Where the offer of a place on a course is accepted, payment must be made by the date indicated on the invoice. As the demand for places can be quite high, refunds will not be provided for late cancellation or non attendance.

Foundation

Welfare Rights Adviser Programme

This course, accredited by OCN Northern Ireland, is designed specifically for new and/or inexperienced advice workers. The aim is to provide a sound foundation in a broad area of welfare rights. The course is assessed and participants are expected to complete home-study assignments. Participants who successfully complete the course work will be awarded certificates. There are no formal entry qualifications but participants should have good literacy skills and basic numeracy skills in order to benefit fully from this course. Tutoring is provided one day a week for ten weeks as follows:

Immigration Law and Practice: an Introduction

This two day course provides advisers with an introduction to UK immigration law and practice, enabling participants to answer basic immigration queries and to identify where specialist assistance is required. In particular, the course will provide an overview of the rules relating to spouses and family members, students, European Union nationals, visitors and asylum. An outline of the immigration appeals system will also be provided. This course is run in partnership with the Office of the Immigration Services Commissioner.

Mental Health Law: an Introduction

This course provides an introduction for those who are interested in advising on the implications of mental health legislation and case law in Northern Ireland. This is an area of law which is continually changing and this course aims to provide advisers with an understanding of key principles.

Foundation / Intermediate

European Economic Area Family Permits

This course is aimed at level one, level two and level three immigration advisers, solicitors, advisers wishing to pursue OISC registration or exemption and other advisers wishing to signpost. Northern Ireland is in a unique position with regard to immigration law as most residents have dual citizenship. This has practical implications, including social security eligibility for non-European nationals wishing to join partners, spouses or family in Northern Ireland. This one day course will review the relevant European regulations and directives and demonstrate their practical application in obtaining EEA family permits and residence documents. The course will explore in detail the different options available under European and UK immigration law.

Intermediate

Accessing Information: the Freedom of Information Act

An opportunity not to be missed. This half day course looks at how legal advisers can make use of the Freedom of Information Act to progress their clients’ cases. Christine O’Neill, Brodies Solicitors, Edinburgh, has experience of advising on the Act and will explore the key issues for advisers.

Asylum and Immigration Tribunal Reconsideration Hearings

This course is aimed at practitioners with experience of representing asylum seekers and immigration cases before immigration judges or with experience in advising on immigration and asylum appeals generally. The aim of the course is to review all aspects of the practice and procedure of the Asylum and Immigration Tribunal (AIT) on reconsideration hearings. The one day course will consider applications to the AIT for reconsideration, analyse ‘material error of law’ and review up to date case law on this issue. It will explore procedural issues arising, including the lodging of fresh evidence, and will look at onward appeals to the Court of Appeal. The focus will be on a practical application of the case law, so as to increase the chances of a successful appeal before the AIT.

Habitual Residence and the Right to Reside

The course looks at the residence tests for benefits and how they affect entitlement. In particular, the course examines the right to reside test as it applies to European Union and Accession State nationals who joined the EU in May 2004. The course will also consider the difficulties faced by EU nationals who are not currently working or who are economically inactive.

Age Discrimination in Employment

The introduction of legislation outlawing age discrimination against workers will have a profound impact on employment practice. This course will provide an overview of the new legislation and how it will work in practice.

Advisers Guide to Community Care

Many older people, people with disabilities, long term illnesses or mental health problems and their carers require assistance from the care system. This course will examine the responsibilities of health and social services trusts in providing care and assistance. The course offers an insight into health and social services law and practice and is aimed at those advisers who have previously advised in this area. Issues such as identifying needs, provision of appropriate services, financial implications of care and housing adaptations will be considered.

Community Care and Mental Incapacity

This course considers responsibilities and obligations towards those with mental incapacity. It will look at decision making on community care services, the role of the Office of Care and Protection and the legal perspective on disputes between care professionals and carers. The course will also examine the departmental guidance ‘Consent to Examination, Treatment and Care’ as it applies to community care.

Tribunal Representation

This six day course is aimed at advisers who have a good understanding of social security law and who wish to develop their skills and knowledge to provide effective advice and representation in relation to challenging social security decisions. The Tribunal Representation course is accredited by OCN Northern Ireland and is assessed. Those who successfully complete the course work will be awarded certificates by OCN Northern Ireland.

The tutor is Nuala Mole, solicitor and director of the AIRE Centre in London. The AIRE (Advice on Individual Rights in Europe) Centre is an organisation which specialises in European law.

Tax Credits: Awards, Revision, Renewals and Overpayments

This is a course for advisers who have working knowledge of the tax credits system. It will examine the system of decision making which is unique to tax credits and will give advisers information on how to deal with common problems caused by the system. The course will cover: the provisional and final awards; the annual renewal process; in year and end of year overpayments; the causes of tax credit overpayments; how to effectively challenge overpayment decisions and additional payments. This course relates only to tax credits; no other social security benefits will be covered.

Taking Cases to the Social Security Commissioner

This course is aimed at advisers with considerable experience in social security appeal tribunals who wish to be able to critically evaluate tribunal decisions, identify grounds of appeal to the Commissioner and understand the stages in the process. The course will enable advisers to identify errors of law in tribunal decisions and familiarise them with the procedures involved in taking Commissioner appeals.

Rights of Migrant Workers

There has been a significant increase in the number of migrant workers coming to Northern Ireland. This course will look at immigration, employment and social security issues facing both migrant workers from existing and new European Union countries and those from outside of the EU. Designed for advisers, trade union work representatives and lawyers in private practice, the course intends to be an introduction to this topical subject covering relevant legislation and recent decisions.

Social Security for Lawyers

This is a practical course focussing on key social security issues that affect the daily work of solicitors. It is aimed at solicitors who are interested in developing their knowledge of social security and will suit those whose work overlaps with social security law.
In particular, the course will cover the savings rules affecting means-tested benefits and how maintenance, personal injury and other compensation awards affect these benefits. The course will also look at the interaction of benefit rules with admittance to residential and nursing home care with particular reference to home ownership and how the social security system deals with shared childcare arrangements.
