Law Centre NI has published a new legal briefing warning advisers that carers with a disability, who have gone through the managed migration process to Universal Credit, can actually be worse off if they are subsequently awarded the Limited Capability for Work Related Activity Component.
This briefing will outline the effect that these circumstances have on the transitional element and provide an overview of how a work capability assessment decision affects the amount of Universal Credit paid to a carer with limited capability for work related activity.
Advisers should note that this briefing does not apply to ESA claimant who are already assessed as having limited capability for work-related activity before going through the managed migration process.
