How to deal with problems at work

Workplace problems can be very upsetting and impact on your home life as well as your work life. If it is the first time you have experienced a workplace problem, you might not know where to turn. There is guidance available on how to deal with workplace problems. Applying this guidance to your own case, should help you to navigate workplace problems more easily. In turn, this could reduce the upset and stress caused by workplace problems.

Alternatives to Legal Proceedings

Before taking a case to the Employment Tribunal, there are options to resolve disputes without formal legal action. These methods can save time, reduce stress, and often help maintain positive working relationships.

These options include:

  • Mediation
  • Arbitration
  • Compromise / Settlement Agreements

Initiating Legal Proceedings

Before making a claim to the Employment Tribunal, it’s important to decide whether legal action is appropriate, identify the legal issues in your case, understand the time limits for bringing a claim, and seek advice and support. This ensures you are prepared and know the steps involved.

Submitting a Claim 

This stage covers the formal steps for starting your Employment Tribunal case. It includes Early Conciliation through the Labour Relations Agency, completing the ET1 claim form, and understanding how the Respondent responds with an ET3. These steps set the foundation for your case and ensure the process moves forward correctly.

The Tribunal Process

If your workplace dispute progresses to the Employment Tribunal, there are several key steps involved. From the initial Case Management Preliminary Hearing to exchanging evidence and information, and finally preparing witness statements before the full hearing.

What to expect from the final hearing

When your case reaches the Employment Tribunal hearing, it’s important to understand how the process works. This includes what happens during the hearing itself, how costs may be awarded, and the limited circumstances under which you can appeal a Tribunal decision. Knowing what to expect helps you prepare and approach the hearing with confidence.
