Work Capability Assessments Explained
Understanding LCW, LCWRA and Your Clients' Rights
The Work Capability Assessment (WCA) is used by the Department for Communities to assess how a claimant’s health condition or disability impacts their ability to work. The WCA plays a key role in determining entitlement to Universal Credit (UC) and New Style Employment and Support Allowance (ESA), as well as the level of work-related conditions that are placed on a claimant.
This guide has been developed by Law Centre NI to help advisers navigate the often complex rules surrounding the Work Capability Assessment and provide accurate, practical support to clients. Drawing on Northern Ireland legislation, case law and departmental guidance, it brings together the key information needed to understand eligibility, prepare evidence, identify potential entitlement to LCW or LCWRA, and challenge incorrect decisions. While the social security system can be difficult to navigate, we hope this guide gives advisers the confidence and knowledge to support claimants throughout the assessment, reconsideration and appeal process.
