The appellant in this case had been represented by Mid & East Antrim Community Advice but the Tribunal failed to address specific matters raised in the submissions provided by the representative. Failure by the Tribunal to address a written submission can amount to an error of law.

Case Overview

Although the Tribunal refers to the existence of a written submission, at no point did it address the submission in its determination and reasoning. In particular, the Tribunal did not specifically address issues raised under Schedule 8 and 9 Universal Credit (Northern Ireland) Regulations 2016 and the rules regarding limited capability for work and limited capability for work-related activity.
